Drive Planning, a Georgia-based financial advisory firm founded by Todd Burkhalter, sold a "Real Estate Acceleration Loan" said to fund short-term loans to real estate developers with a guaranteed 10% return every three months, plus a tax lien fund. Investors did not need to be accredited and were encouraged to use retirement accounts, savings and lines of credit. Between September 2020 and June 2024, Burkhalter defrauded more than 2,000 investors out of about $380 million. None of the loan money financed loans; it paid earlier investors, agents' commissions and Burkhalter's spending on a yacht, a Cabo San Lucas condo, luxury vehicles and private jets.
Burkhalter pleaded guilty to wire fraud in January 2026. On August 14, 2026, he was sentenced to 20 years in federal prison, the maximum, and ordered to pay $233,777,763.82 in restitution. Two other executives received prison terms that week. The SEC sued in August 2024, and court-appointed receiver Kenneth D. Murena is recovering assets to repay victims.
